Acceptance and scope
These Terms apply to all users of our site and services including visitors, registered users, and clients that purchase advisory or enterprise engagements. Our quizzes are provided for informational purposes and to help teams prioritize market experiments. Reports and recommendations are based on questionnaire responses, benchmarking, and modeled heuristics; they are not a guarantee of future outcomes. You are responsible for how you implement suggestions and for obtaining any expert advice required for your specific situation. We reserve the right to refuse service, limit access, or terminate accounts that are abusive, fraudulent, or that violate these Terms.
User obligations and acceptable use
You agree to use our services lawfully and ethically. Prohibited activities include attempting to reverse-engineer our scoring engine, harvesting data for resale, uploading content that violates third-party rights, or using the site to distribute malicious software. When you submit content or quiz responses, ensure you have the rights required to share that content. You are responsible for maintaining the confidentiality of any account credentials and for all actions taken under your account. If you become aware of any breach of security, you must notify us promptly. We may suspend or remove content that violates these Terms or for any other reason at our discretion.
Intellectual property
Quizzience and its licensors retain all rights, title, and interest in and to the service, underlying technology, and content provided by Quizzience, including quizzes, reports, designs, trademarks and trade secrets. You are granted a limited, non-exclusive, non-transferable license to use outputs provided to you for internal business purposes, subject to compliance with these Terms. You may not copy, reproduce, modify, create derivative works, publicly display, or redistribute Quizzience-provided content except as expressly permitted. If you submit feedback or suggestions, you grant Quizzience a perpetual, royalty-free license to use and incorporate such feedback without obligation to you.
Disclaimer of warranties and limitation of liability
The service is provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law, Quizzience disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free. In no event will Quizzience, its officers, directors, or suppliers be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our aggregate liability for direct damages will be limited to the amount paid by you to Quizzience in the twelve months preceding the claim, or one hundred US dollars if you have not paid us. Some jurisdictions do not permit certain limitations; where prohibited, liability will be limited to the maximum extent permitted by law.
Termination and suspension
We may suspend or terminate access to all or part of the service at any time for conduct that we reasonably believe violates these Terms, for non-payment, or for security concerns. On termination, your right to access the service ceases. We may retain certain information for legitimate business and legal purposes such as fraud prevention, accounting, and compliance with legal obligations. If you have an enterprise agreement, termination rights and data return provisions may be governed by that separate agreement.
Governing law and dispute resolution
These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law rules. For disputes that cannot be resolved informally, you and Quizzience agree to submit to the exclusive jurisdiction of state and federal courts located in New York County, New York. If a provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. These Terms constitute the entire agreement between you and Quizzience regarding the service and supersede any prior agreements.
